Biography of Speaker:

Mr. Valentine Yim is a practising barrister at Bernacchi Chambers. He was called to the Bar in 1986, and his practice is in civil law with emphases on property law, conveyancing disputes, New Territories land, Chinese law and customs, land resumption, land valuation and compensation, probate disputes, town planning and judicial review.

Mr. Jeff Yau is a practising barrister at Bernacchi Chambers. He was called to the Bar in 2020. He has a broad civil practice with a primary focus on commercial disputes, company and insolvency law, land and property as well as probate, trusts and mental health matters. He is also a Professional Consultant at the Faculty of Law of the Chinese University of Hong Kong teaching the conveyancing and probate practice module on its Postgraduate Certificate in Laws course.

The number of litigations in adverse possession (“AP”) has been on the rise in Hong Kong for the past 20 years or so. The speakers, practising barristers, would like to share their thoughts on the following topics:

1. Why AP happens in HK and why AP litigations are on the rise.

2. Some essential black-letter law on AP.

3. Defences to a claim in AP.

4. The worth of a possessory title, if established:

  • Possession and quiet enjoyment;
  • Can a possessory title be sold? If yes, how?

5. Useful practical tips for AP litigation, such as:

  • How best to prove actual possession?
  • What precautionary steps to take if client is old or infirmed, or both;
  • What sort of expert evidence is needed, from whom, and when.

6. What the future holds for AP.
