Synopsis of Lecture:

Chinese trust law requires trusts created over certain types of property to be registered, while no guidance has been provided on this registration requirement, considerably hindering the development of real estate trusts in China. The speaker seeks to first answer the most fundamental question: why does the Chinese trust law require the registration of trusts? After the underlying rationale is revealed, an attempt is made to offer suggestions for the implementation of the registration of trusts with lessons drawn from English trust law, which also furnishes comparative law scholarship with broader insights into rule transplantation and reconciliation.
